Terms of Service

StudyPebble (the “Service”) is operated by the StudyPebble team (“StudyPebble,” “we,” “us” or “our”). These Terms of Service (the “Terms”) form a binding agreement between you and us and govern your access to and use of studypebble.com, the StudyPebble applications, and everything we make available through them.

By creating an account, starting a subscription, or otherwise using the Service, you confirm that you have read and agree to these Terms and to our Privacy Policy, which is incorporated here by reference. If you do not agree to these Terms, do not use the Service.

If you are using the Service on behalf of a school, district, or other organization, you represent that you are authorized to accept these Terms on that organization’s behalf, and “you” refers to that organization. Separate written agreements with institutions control over these Terms where they conflict.

You must be at least 13 years old to use the Service. If you are between 13 and the age of majority where you live, you may use the Service only with the knowledge and consent of a parent or legal guardian, who accepts these Terms with you and is responsible for your use of the Service and for any charges you incur.

The Service is not directed to children under 13, and we do not knowingly allow anyone under 13 to create an account. If we learn that we hold an account belonging to a child under 13 without verifiable parental consent, we will close it and delete the associated data.

You may not use the Service if you have previously been suspended or removed from it, or if doing so would be prohibited by the laws that apply to you.

Some features are available without an account. For the rest, you will need to register with an accurate email address and keep your account information current.

• Accounts are personal. One account is for one person, and you may not share, sell, transfer, or let anyone else use your login.
• You are responsible for everything that happens under your account, including all activity and all charges.
• Keep your credentials confidential, and tell us promptly at support@studypebble.com if you believe someone else has gained access to your account.
• We may refuse, reclaim, or require you to change a username or account detail that we reasonably consider misleading or infringing.

StudyPebble is an adaptive preparation platform for the digital SAT. It provides original practice questions, explanations, practice tests, progress tracking, study plans, and related study tools.

No score or outcome guarantee. We do not promise any particular score, score improvement, exam result, admissions outcome, scholarship, or other result. Score projections, mastery estimates, and difficulty ratings shown in the Service are statistical estimates produced from your own practice data. They are not predictions of your official results and should not be treated as such.

We are continuously improving the Service, which means features may be added, changed, limited, or withdrawn. Where a change materially reduces the paid functionality you are subscribed to, your remedy is the cancellation right in Section 6.

The Service is a study aid. It does not replace official test materials, your school, or professional academic advice.

You agree not to do any of the following, and not to help anyone else do them:

• Use the Service to cheat on, or gain an unfair advantage in, any actual examination, or to assist anyone else in doing so.
• Copy, scrape, crawl, download in bulk, record, republish, resell, distribute, tutor from commercially, or otherwise exploit our questions, explanations, or other materials outside your own personal study.
• Upload, submit, or share content you do not have the right to share, including material that reproduces a real, secure, or copyrighted examination.
• Use the Service, or its output, to build, train, fine tune, benchmark, or improve any competing product, model, or dataset.
• Probe, scan, overload, disrupt, reverse engineer, or attempt to defeat any security, rate limit, paywall, or access control in the Service.
• Access the Service through automated means, or through an account created for someone other than yourself, except where we have given written permission.
• Harass, threaten, impersonate, or infringe the rights of any other user, our staff, or any third party, or submit unlawful, hateful, or sexually explicit material.
• Misrepresent your affiliation with StudyPebble, or use our name, logo, or mascot in a way that implies endorsement we have not given.

We may investigate and take action on any suspected breach, including removing content, limiting features, or closing your account under Section 16.

Parts of the Service are free. Paid plans (“Pro”) unlock additional features and are sold on a recurring subscription basis. The price, billing period, and what is included are shown on our pricing page and at checkout, and the terms presented to you at checkout form part of this agreement.

Authorization and payment processing

Payments are processed by Stripe. We do not receive or store your full card number. By subscribing, you authorize us and Stripe to charge your chosen payment method for the subscription fee plus any applicable taxes, on each renewal, until you cancel. You are responsible for keeping a valid payment method on file. If a charge fails, we may retry it and may suspend paid features until payment succeeds.

Automatic renewal

Paid subscriptions renew automatically. At the end of each billing period, your subscription renews for another period of the same length at the then current price, and your payment method is charged automatically, unless you cancel before the renewal date. Any free or discounted introductory period, where one is offered, converts to a paid subscription at the standard rate at the end of that period unless you cancel first.

How to cancel

You can cancel at any time from your profile page, under Your subscription, which opens Stripe’s billing portal. Cancellation stops future charges. It takes effect at the end of the billing period you have already paid for, and you keep paid access until then. Cancelling does not reverse charges that have already been made.

Price changes

We may change subscription prices. If a price change affects your existing subscription, we will give you notice by email before it takes effect, and the new price will apply from your next renewal. You may cancel before that renewal if you do not accept the new price.

Taxes

Prices are shown in United States dollars. You are responsible for any sales, use, value added, or similar taxes that apply, other than taxes on our income.

Subscription fees are non-refundable except where refunds are required by the law that applies to you, or where we expressly agree to one in writing. We do not refund a billing period that has already been charged, and we do not provide partial refunds for unused time, unused questions, or periods during which you chose not to use the Service.

If you believe you have been charged in error, or you were charged after cancelling, contact support@studypebble.com with the details and we will review it. Nothing in this section limits any statutory refund or cancellation right you have as a consumer where you live.

Purchases made through a third party app store are subject to that store’s refund policy, and refund requests for those purchases must be made to the store.

The Service and everything in it, including the practice questions, answer choices, explanations, practice tests, study plans, adaptive and rating logic, software, text, design, layout, the StudyPebble name, and the Pebble mascot, are owned by us or our licensors and are protected by copyright, trademark, and other laws.

Our questions are original content. StudyPebble practice questions and explanations are written or generated for StudyPebble and aligned to published skill categories. They are not reproductions of real, released, or secure College Board examinations.

Subject to these Terms and to payment of any applicable fees, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service and its materials for your own personal, non-commercial study only. You may take notes and print or save a reasonable number of items for your own revision. You may not reproduce, distribute, publish, perform, resell, license, bundle, teach commercially from, or create derivative works from our materials, and you may not use them as training or evaluation data. All rights not expressly granted are reserved.

Trademarks of others

SAT and College Board are trademarks registered by the College Board, which is not affiliated with StudyPebble and does not sponsor, endorse, review, or approve the Service or its content. Other marks referenced on the Service belong to their respective owners and are used for identification only.

Copyright complaints

If you believe material on the Service infringes your copyright, send a notice with enough detail to identify the work and the material, your contact information, and a statement of good faith belief, to support@studypebble.com. We will review and, where appropriate, remove the material and may terminate repeat infringers.

“Your Content” means anything you submit to the Service, including written answers, chat messages to the AI tutor, notes, reports, and testimonials you choose to give us. You keep ownership of Your Content.

You grant us a worldwide, non-exclusive, royalty-free license to host, store, copy, transmit, display, and process Your Content to the extent needed to operate, secure, support, and improve the Service, and to comply with law. That license ends when you delete the content or your account, except for copies already made for backup, security, or legal retention, and except where the content has been de-identified and aggregated so that it no longer identifies you.

You represent that you have the rights needed to submit Your Content and that it does not breach Section 5. We may remove content that we reasonably believe breaches these Terms or the law, but we have no obligation to monitor or store it, and you should keep your own copies of anything you care about.

If you send us suggestions, feature requests, bug reports, or other feedback, you agree we may use it without restriction, credit, or payment. If you give us a public testimonial or review, you agree we may quote it, with the attribution you provided, in materials about the Service until you ask us to stop.

The Service uses artificial intelligence models to generate and review practice questions, write explanations, grade written responses, and power the AI tutor. Content and grades produced this way can be incomplete, outdated, or simply wrong, and two similar questions may receive different treatment.

You should treat AI generated output as a study aid to be checked, not as an authoritative source, and you should verify anything important against official test materials or your teacher. You are responsible for how you use the output. Where you believe a question or explanation is wrong, please report it so we can fix it.

Our Privacy Policy explains what is sent to our AI provider when these features are used.

The Service relies on third party providers, including hosting, database, authentication, payment, AI, and analytics providers, which are identified in our Privacy Policy. It may also link to sites and resources we do not control.

Your use of a third party service, including any purchase made through one, is governed by that provider’s own terms and privacy policy. We are not responsible for third party content, availability, or practices, and a link is not an endorsement.

How we collect, use, share, and retain personal information, and how you can request access to or deletion of your data, is described in our Privacy Policy. By using the Service you agree to the handling of information described there.

To the maximum extent permitted by applicable law, the Service and all content in it are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory. We specifically disclaim the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Without limiting that, we do not warrant that the Service will be uninterrupted, timely, secure, or error free, that defects will be corrected, that content, answers, grades, or score estimates will be accurate or complete, or that the Service will meet your requirements or produce any particular result.

Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you. In that case the exclusions apply to the greatest extent permitted by law.

To the maximum extent permitted by applicable law, neither StudyPebble nor its owners, employees, contractors, suppliers, or licensors will be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, study time, exam opportunity, admissions outcome, or other intangible loss, arising out of or relating to these Terms or your use of or inability to use the Service, even if we have been advised of the possibility of such damages, and regardless of the theory of liability.

To the maximum extent permitted by applicable law, our total aggregate liability for all claims relating to the Service is limited to the greater of (a) the total amount you paid us for the Service in the twelve months before the event giving rise to the claim, and (b) one hundred United States dollars (US$100).

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud or for death or personal injury caused by negligence. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

These limitations are a fundamental part of the bargain between you and us and apply even if a limited remedy is found to have failed its essential purpose.

You agree to defend, indemnify, and hold harmless StudyPebble and its owners, employees, contractors, suppliers, and licensors from and against any claims, demands, proceedings, losses, liabilities, damages, costs, and expenses, including reasonable legal fees, arising out of or relating to: your use of the Service; Your Content; your breach of these Terms or of any applicable law; your infringement of anyone’s intellectual property or other rights; or any use of the Service under your account.

We may take over the exclusive defense and control of any matter subject to indemnification by you, at your expense, and you agree to cooperate with our defense and not to settle any such matter without our written consent.

You may stop using the Service at any time, cancel a paid plan as described in Section 6, and request deletion of your account by writing to support@studypebble.com.

We may suspend or terminate your access, in whole or in part, with or without notice, if we reasonably believe you have breached these Terms, if your use creates risk or legal exposure for us or other users, if payment is unpaid, or if we discontinue the Service. Where the reason permits it, we will give you notice and an opportunity to put things right.

On termination, your license to use the Service ends and paid access stops. Sections covering intellectual property, feedback, disclaimers, limitation of liability, indemnification, governing law, and the general provisions survive. Terminating an account does not entitle you to a refund except as set out in Section 7 or as required by law.

We may update these Terms as the Service and the law change. When we do, we will revise the “Last updated” date at the top of this page. If a change is material, we will give reasonable additional notice, for example by email to the address on your account or by a notice in the Service, before it takes effect.

Changes are not retroactive. If you continue to use the Service after a change takes effect, you accept the updated Terms. If you do not accept them, stop using the Service and cancel any paid plan before the change takes effect.

These Terms live on a single page so there is never a question about which version applies.

These Terms and any dispute arising out of them or out of your use of the Service are governed by the laws of the United States and of the state in which StudyPebble is established, without regard to conflict of law rules.

Any dispute not resolved informally may be brought in a court of competent jurisdiction. Nothing here prevents either party from seeking injunctive relief to protect its intellectual property in any competent court.

Before filing a claim, please contact us at support@studypebble.com so we can try to resolve it informally. If you live somewhere whose law gives you the right to bring proceedings in your local courts, or to rely on your local consumer law, this section does not take that right away.

Any claim relating to the Service must be brought within one year after it arises, to the extent that limit is permitted by applicable law.

• Entire agreement. These Terms, the Privacy Policy, and the terms shown to you at checkout are the whole agreement between you and us about the Service, and replace any earlier understanding about it.
• Severability. If any provision is held unenforceable, it is limited or removed to the minimum extent necessary and the rest remains in force.
• No waiver. If we do not enforce a provision, that is not a waiver of our right to enforce it later.
• Assignment. You may not assign or transfer these Terms without our written consent. We may assign them to an affiliate or in connection with a merger, acquisition, or sale of assets.
• Force majeure. Neither party is liable for delays or failures caused by events outside its reasonable control.
• No third party beneficiaries. These Terms do not create rights for anyone other than you and us.
• Notices. We may send you notices by email to the address on your account or by posting them in the Service. You should send notices to us at the address in Section 20.
• Headings and summaries. Headings and the summary at the top of this page are for convenience and do not affect interpretation.
